Key Changes Under the Residential Tenancies Act 2026 for Landlords and Tenants
Earlier this month, Róisín Bennett Partner and head of our property team briefed the accountancy body ACCA on the key changes introduced by the Residential Tenancies Act 2026. Since introduction of the legislation on 1 March 2026, Róisín has seen a marked increase in the number of enquiries from both landlord and tenants. Róisín says that landlords in particular, need to exercise care when dealing with lettings given the complexities of the legislation. The Act has changed how legal rights and duties are determined dividing the real estate market into large and small landlords and also pre-1 March 2026 lettings and post 1 March 2026 lettings. Landlords need to be mindful of the multi-layer system now in place and to ensure strict compliance with the provisions of the Act. Given the myriads of changes brought about by the 2026 Act, landlords need to be careful about issuing out of date letting agreements. Róisín works in a voluntary capacity with the Dublin Solicitors Bar Association who are producing an updated form of Residential Tenancy Letting Agreement to cover the issues arising from the amendments introduced in the 2026 Act.
