Notice of fees for appeals in relation to vacant sites

An appeal can be brought to An Bord Pleanála against the placing of the site on the vacant sites register. This is dealt with in Sections 9, 11 and 18 of the Act. Currently, no fee exists for such an appeal.

Please note that as and from 1 April 2019 a fee of €500.00 will apply to any appeal to An Bord Pleanála under Sections 9, 11 and 18 of the Act.

If you are the owner of a property which has been placed on the vacant sites register in 2018, local authorities are currently issuing demands for payment of the levy. A right of appeal under Section 18 of the Act exists against the demand for payment where such appeal is made within 28 days of the date of demand. Until 1 April 2019, such an appeal is free and provides a landowner another opportunity to seek to have the levy cancelled. The levy will increase to 7% of market value in January 2020 from 3% this year in an effort to stimulate development of vacant sites.
